"When Sa'd bin Hisham bin Amir came to visit us, he told us that he came to Ibn Abbas and asked him about the witr of the Messenger of Allah (ﷺ). He said: 'Shall I not tell you of the most knowledgeable person on Earth about the witr of the Messenger of Allah (ﷺ)?' I said: 'Who?' He said: 'Aishah.' So we went to her and greeted her with Salam and entered and asked her. I said: 'Tell me about the witr of the Messenger of Allah (ﷺ).' She said: 'We used to prepare for him his siwak and water for wudu, then Allah (SWT) would wake him when He willed to wake him at night. He would clean his teeth and perform wudu, then he would pray nine rak'ahs, during which he would not sit until the eighth. Then he would praise Allah (SWT) and remember Him and supplicate, then he would get up and not say the taslim. Then he would pray the ninth, then sit and praise Allah (SWT) and remember Him and supplicate, then he would say a taslim that we could hear. Then he prayed two rak'ahs sitting, and that was eleven rak'ahs, O my son. When the Messenger of Allah (ﷺ) grew older and put on weight, he prayed witr with seven, then he prayed two rak'ahs sitting after saying the taslim, and that was nine, O my son. And when the Messenger of Allah (ﷺ) offered a prayer, he liked to persist in offering it.'"
Sunan an-Nasa'i Book 20, Hadith 124
One of the daughters of `Uthman died at Mecca. We went to attend her funeral procession. Ibn `Umar
and Ibn `Abbas were also present. I sat in between them (or said, I sat beside one of them. Then a man
came and sat beside me.) `Abdullah bin `Umar said to `Amr bin `Uthman, "Will you not prohibit
crying as Allah's Messenger (ﷺ) has said, 'The dead person is tortured by the crying of his relatives.?" Ibn
`Abbas said, "`Umar used to say so." Then he added narrating, "I accompanied `Umar on a journey
from Mecca till we reached Al-Baida. There he saw some travelers in the shade of a Samura (A kind
of forest tree). He said (to me), "Go and see who those travelers are." So I went and saw that one of
them was Suhaib. I told this to `Umar who then asked me to call him. So I went back to Suhaib and
said to him, "Depart and follow the chief of the faithful believers." Later, when `Umar was stabbed,
Suhaib came in weeping and saying, "O my brother, O my friend!" (on this `Umar said to him, "O
Suhaib! Are you weeping for me while the Prophet (ﷺ) said, "The dead person is punished by some of the
weeping of his relatives?" Ibn `Abbas added, "When `Umar died I told all this to Aisha and she said,
'May Allah be merciful to `Umar. By Allah, Allah's Messenger (ﷺ) did not say that a believer is punished by
the weeping of his relatives. But he said, Allah increases the punishment of a non-believer because of
the weeping of his relatives." Aisha further added, "The Quran is sufficient for you (to clear up this
point) as Allah has stated: 'No burdened soul will bear another's burden.' " (35.18). Ibn `Abbas then
said, "Only Allah makes one laugh or cry." Ibn `Umar did not say anything after that.
Sahih al-Bukhari Book 23, Hadith 46
Yahya related to me from Malik from Yahya ibn Said that Said ibn
al-Musayyab said, "The slave girl is not married when there is a free
woman who is a wife unless the free woman wishes it. If the free woman
complies, she has two-thirds of the division of time."
Malik
said, "A free man must not marry a slave-girl when he can afford to
marry a free-woman, and he should not marry a slave-girl when he
cannot afford a free woman unless he fears fornication. That is
because Allah, may he be Blessed and Exalted, says in His Book, 'If
you are not affluent enough to marry believing women, who are
muhsanat, take slave-girls who are believing women that your right
hands own.' (Sura 4 ayat 24) He says, 'That is for those of you who
fear al-anat.' "
Malik said, "Al-anat is fornication."
Muwatta Malik Book 28, Hadith 31
Yahya related to me from Malik from Abdu Rabbih ibn Said ibn Qays
that Abu Salama ibn Abd ar-Rahman said that Abdullah ibn Abbas and Abu
Hurayra were asked when a pregnant woman whose husband had died could
remarry. Ibn Abbas said, "At the end of two periods." Abu Hurayra
said, "When she gives birth, she is free to marry." Abu Salama ibn Abd
ar-Rahman visited Umm Salama, the wife of the Prophet, may Allah bless
him and grant him peace, and asked her about it Umm Salama said,
''Subaya al-Aslamiya gave birth half a month after the death of her
husband, and two men asked to marry her. One was young and the other
was old. She preferred the young man and so the older man said, 'You
are not free to marry yet.' Her family were away and he hoped that
when her family came, they would give her to him. She went to the
Messenger of Allah, may Allah bless him and grant him peace, and he
said, 'You are free to marry, so marry whomever you wish.' "
