Yahya related to me from Malik from Nafi that Abdullah ibn Umar
would say, "A man should not have intercourse with a slave girl except
one whom, if he wished, he could sell, if he wished, he could give
away, if he wished, he could keep, if he wished, he could do with her
what he wanted ."
Malik said that a man who bought a slave-
girl on condition that he did not sell her, give her away, or do
something of that nature, was not to have intercourse with her. That
was because he was not permitted to sell her or to give her away, so
if he did not own that from her, he did not have complete ownership of
her because an exception had been made concerning her by the hand of
someone else. If that sort of condition entered into it, it was a
messy situation, and the sale was not recommended.
Muwatta Malik Book 31, Hadith 6
While a Jew was selling goods, he was given something which he did not accept or he did not agree (to accept) that 'Abdul 'Azlz (one of the narrators) is doubtful about it. He (the Jew) said: By Allah, Who chose Moses (peace be upon him) among mankind. A person from the Ansar heard it and gave a blow at his face saying: (You have the audacity) to say: By Him Who chose Moses amongst mankind, whereas Allah's Messenger (ﷺ) is living amongst us. The Jew went to Allah's Messenger (ﷺ) and said: Abu'l-Qasim, I am a Dhimmi and (thus need your protection) by a covenant, and added: Such and such person has given a blow upon my face. Thereupon Allah's Messenger (ﷺ) said: Why did you give a blow on his face? He said: Allah's Messenger, this man said: By Him Who chose Moses (peace be upon him) amongst mankind, whereas you are living amongst us. Allah's Messenger (ﷺ) became angry and signs of anger could be seen on his face, and then said: Don't make distinction amongst the Prophets of Allah. When the horn will be blown and whatever is in the heavens and the earth would swoon but he whom Allah grants exception, then another horn will be blown and I would be the first amongst those who would recover and Moses (peace be upon him) would be catching hold of the Throne and I do not know whether it is a compensation for that when he swooned on the Day of Tur or he would be resurrected before me and I do not say that anyone is more excellent than Yunus son of Matta (peace he upon him).
Sahih Muslim Book 43, Hadith 209
"I saw Allah's Messenger (ﷺ) delaying the Maghrib prayer till he offered it along with the `Isha' prayer
whenever he was in a hurry during the journey." Salim narrated, "Ibn `Umar used to do the same
whenever he was in a hurry during the journey." And Salim added, "Ibn `Umar used to pray the
Maghrib and `Isha' prayers together in Al-Muzdalifa." Salim said, "Ibn `Umar delayed the Maghrib
prayer because at that time he heard the news of the death of his wife Safiya bint Abi `Ubaid. I said to
him, 'The prayer (is due).' He said, 'Go on.' Again I said, 'The prayer (is due).' He said, 'Go on,' till we
covered two or three miles. Then he got down, prayed and said, 'I saw the Prophet (ﷺ) praying in this way,
whenever he was in a hurry during the journey.' `Abdullah (bin `Umar) added, "Whenever the
Prophet was in a hurry, he used to delay the Maghrib prayer and then offer three rak`at (of the
Maghrib) and perform Taslim, and after waiting for a short while, Iqama used to be pronounced for
the `Isha' prayer when he would offer two rak`at and perform Taslim. He would never offer any
optional prayer till the middle of the night (when he used to pray the Tahajjud)."
Sahih al-Bukhari Book 18, Hadith 12
"While we were with the Messenger of Allah in the early hours of the morning, some people came who were naked and barefoot, with their swords hung (around their necks). Most of them, may all of them, belonged to the tribe of Mudar. The face of the Messenger of Allah changed when he saw them in poverty. He went in (to his house) then he came out and ordered Bilah to call the Adhan and then the Iqamah. He (the Prophet) prayed, tjem je addressed te,, (reciting the Verses): 'O mankind! Be dutiful to your Lord, Who created you from a single person (Adam), and from him(Adam) He created his wife Then they gave in charity, some giving a Dinar, others a Dirham, or a garment, or a Sa' of wheat or, a Sa' of dates, until he said: 'Even half a date.' A man from among the Ansar came with a bag of money which his hands could hardly lift. The people followed one another (in giving charity) until I saw two heaps of food and clothing, and I saw the face of the Messenger of Allah shining like gold (with joy). The Messenger of Allah said: 'Whoever sets a good precedent in Islam, he will have the reward for that, and the reward of those who acted in accordance with it, without that detracting from their reward in the slightest. And whoever sets an evil precedent in Islam, he will have a burden of sin for that, and the burden of those who acted in accordance with it, without that detracting from their burden in the slightest."'
Sunan an-Nasa'i Book 23, Hadith 120
Yahya said that he heard Malik speak about a man who bought goods
- animals or clothes or wares, and the sale was found not to be
permitted so it was revoked and the one who had taken the goods was
ordered to return the owner his goods. Malik said, "The owner of the
goods only has their value on the day they were taken from him, and
not on the day they are returned to him. That is because the man is
liable for them from the day he took them and whatever loss is in them
after that is against him. For that reason, their increase and growth
are also his. A man may take the goods at a time when they are selling
well and are in demand, and then have to return them at a time when
they have fallen in price and no one wants them. For instance, the man
may take the goods from the other man, and sell them for ten dinars or
keep them while their price is that. Then he may have to return them
while their price is only a dinar. He should not go off with nine
dinars from the man's property. Or perhaps they are taken by the man,
and he sells them for a dinar or keeps them, while their price is only
a dinar, then he has to return them, and their value on the day he
returns them is ten dinars. The one who took them does not have to pay
nine dinars from his property to the owner. He is only obliged to pay
the value of what he took possession of on the day it was taken ."
He said, "Part of what clarifies this is that when a thief
steals goods, only their price on the day he stole them is looked at.
If cutting off the hand is necessary because of it, that is done. If
the cutting off is delayed, either because the thief is imprisoned
until his situation is examined or he flees and then is caught, the
delay of the cutting off of the hand does not make the hadd, which was
obliged for him on the day he stole, fall from him even if those goods
become cheap after that. Nor does delay oblige cutting off the hand if
it was not obliged on the day he took those goods, even if they become
expensive after that."
Muwatta Malik Book 37, Hadith 9
We went out with Allah's Messenger (ﷺ) to Khaibar and we travelled during the night. A man amongst the
people said to 'Amir bin Al-Aqwa', "Won't you let us hear your poetry?" 'Amir was a poet, and so he
got down and started (chanting Huda) reciting for the people, poetry that keep pace with the camel's
foot steps, saying, "O Allah! Without You we would not have been guided on the right path, neither
would we have given in charity, nor would we have prayed. So please forgive us what we have
committed. Let all of us be sacrificed for Your cause and when we meet our enemy, make our feet
firm and bestow peace and calmness on us and if they (our enemy) will call us towards an unjust thing
we will refuse.
The infidels have made a hue and cry to ask others help against us. Allah's Messenger (ﷺ) said, "Who is that
driver (of the camels)?" They said, "He is 'Amir bin Al-Aqwa."' He said, "May Allah bestow His
mercy on him." A man among the people said, Has Martyrdom been granted to him, O Allah's
Prophet! Would that you let us enjoy his company longer." We reached (the people of) Khaibar and
besieged them till we were stricken with severe hunger but Allah helped the Muslims conquer
Khaibar. In the evening of its conquest the people made many fires. Allah's Messenger (ﷺ) asked, "What are
those fires? For what are you making fires?" They said, "For cooking meat." He asked, "What kind of
meat?" They said, "Donkeys' meat." Allah's Messenger (ﷺ) said, "Throw away the meat and break the
cooking pots." A man said, O Allah's Messenger (ﷺ)! Shall we throw away the meat and wash the cooking
pots?" He said, "You can do that too." When the army files aligned in rows (for the battle), 'Amir's
sword was a short one, and while attacking a Jew with it in order to hit him, the sharp edge of the
sword turned back and hit 'Amir's knee and caused him to die.
When the Muslims returned (from the battle), Salama said, Allah's Messenger (ﷺ) saw me pale and said,
'What is wrong with you?"' I said, "Let my parents be sacrificed for you! The people claim that all the
deeds of Amir have been annulled." The Prophet (ﷺ) asked, "Who said so?" I replied, "So-and-so and soand-
so and Usaid bin Al-Hudair Al-Ansari said, 'Whoever says so is telling a lie. Verily, 'Amir will
have double reward."' (While speaking) the Prophet (ﷺ) put two of his fingers together to indicate that,
and added, "He was really a hard-working man and a Mujahid (devout fighter in Allah's Cause) and
rarely have there lived in it (i.e., Medina or the battle-field) an "Arab like him."
Sahih al-Bukhari Book 78, Hadith 174
Yahya related to me from Malik that he had heard some of the
people of knowledge say, "If someone goes into ihram to do umra and
then wants to go into ihram to do hajj as well, he can do so, as long
as he has not done tawaf of the House and s'ay between Safa and Marwa.
This is what Abdullah ibn 'Umar did when he said, 'If I am blocked
from the House we shall do what we did when we were with the Messenger
of Allah, may Allah bless him and grant him peace.' He then turned to
his companions and said, 'It is the same either way. I call you to
witness that I have decided in favour of hajj and umra together. ' "
Malik said, "The companions of the Messenger of Allah, may
Allah bless him and grant him peace, went into ihram to do umra in the
year of the farewell hajj, and the Messenger of Allah, may Allah bless
him and grant him peace, said to them, 'Anyone that has a sacrificial
animal with him should go into ihram to do hajj and umra together, and
he should not come out of ihram until he has finished both.' "
Muwatta Malik Book 20, Hadith 43
that 'Umar bin Al-Khattab was asked about this Ayah: And when your Lord brought forth from the Children of Adam, from their loins, their seed and made them testify as to themselves: "Am I not your Lord?" They said: "Yes! We testify," lest you should say on the Day of Resurrection: 'Verily, we have been unaware of this (7:172).'" So 'Umar bin Al-Khattab said: "I heard the Messenger of Allah (ﷺ) being asked about it. So the Messenger of Allah (ﷺ) said: 'Indeed Allah created Adam, then He wiped his back with His Right Hand, and his offspring came out of him. So he said: "I created these for Paradise, and they will do the deeds of the people of Paradise." Then He wiped his back, and his offspring came out of him. So He said: "I created these for the Fire, and they will do the deeds of the people of the Fire." A man said: 'Then of what good is doing deeds O Messenger of Allah!' The Messenger of Allah (ﷺ) said: 'Verily, when Allah created a man for Paradise, He makes him perform the deeds of the people of Paradise, until he dies doing one of the deeds of the people of Paradise. So Allah will admit him into Paradise. And when He created a man for the Fire, He makes him perform the deeds of the people of the Fire until he dies doing the deeds of the people of the Fire. So Allah will enter him into the Fire.'"
Jami` at-Tirmidhi Book 47, Hadith 127
Yahya related to me from Malik from Ibn Shihab from Abbad ibn
Ziyad, a descendant of al-Mughira ibn Shuba from his father from al
Mughira ibn Shuba that the Messenger of Allah, may Allah bless him and
grant him peace, went to relieve himself during the expedition of
Tabuk. Mughira said, "I went with him, taking water. Then the
Messenger of Allah, may Allah bless him and grant him peace, came back
and I poured out the water for him. He washed his hands and then went
to push his hands out of the sleeves of his garment, but could not do
so because of their narrowness. So he brought them out from underneath
his garment. Then he washed his arms, wiped his head and wiped over
his leather socks. The Messenger of Allah, may Allah bless him and
grant him peace, returned and Abdar Rahman ibn Awf was leading the
people in prayer, and he had already finished one raka with them. The
Messenger of Allah, may Allah bless him and grant him peace, prayed
the remaining raka with them to everyone's concern. When the Messenger
of Allah, may Allah bless him and grant him peace, finished he said,
'You have acted correctly.' "
Muwatta Malik Book 2, Hadith 41
Allah's Messenger (ﷺ) said, "Tomorrow I will give the flag to a man with whose leadership Allah will grant
(the Muslim) victory." So the people kept on thinking the whole night as to who would be given the
flag. The next morning the people went to Allah's Messenger (ﷺ) and every one of them hoped that he would
be given the flag. The Prophet (ﷺ) said, "Where is `Ali bin Abi Talib?" The people replied, "He is
suffering from eye trouble, O Allah's Messenger (ﷺ)." He said, "Send for him and bring him to me." So when
`Ali came, the Prophet (ﷺ) spat in his eyes and invoked good on him, and be became alright as if he had
no ailment. The Prophet (ﷺ) then gave him the flag. `Ali said, "O Allah's Messenger (ﷺ)! Shall I fight them (i.e.
enemy) till they become like us?" The Prophet (ﷺ) said, "Proceed to them steadily till you approach near
to them and then invite them to Islam and inform them of their duties towards Allah which Islam
prescribes for them, for by Allah, if one man is guided on the right path (i.e. converted to Islam)
through you, it would be better for you than (a great number of) red camels."
