Allahu Akbar (Allah is the Greatest). Khaibar is ruined. And when we get down in the valley of a people evil is the morning of the warned ones. He repeated it thrice. In the meanwhile the people went out for their work, and said: By Allah, Muhammad (has come). Abd al-'Aziz or some of our companions said: Muhammad and the army (have come). He said: We took it (the territory of Khaibar) by force, and there were gathered the prisoners of war. There came Dihya and he said: Messenger of Allah, bestow upon me a girl from among the prisoners. He said: Go and get any girl. He made a choice for Safiyya daughter of Huyayy (b. Akhtab). There came a person to Allah's Apostle (ﷺ) and said: Apostle of Allah, you have bestowed Safiyya bint Huyayy, the chief of Quraiza and al-Nadir, upon Dihya and she is worthy of you only. He said: Call him along with her. So he came along with her. When Allah's Apostle (ﷺ) saw her he said: Take any other woman from among the prisoners. He (the narrator) said: He (the Holy Prophet) then granted her emancipation and married her. Thabit said to him: Abu Hamza, how much dower did he (the Holy Prophet) give to her? He said: He granted her freedom and then married her. On the way Umm Sulaim embellished her and then sent her to him (the Holy Prophet) at night. Allah's Apostle (ﷺ) appeared as a bridegroom in the morning. He (the Holy Prophet) said: He who has anything (to eat) should bring that. Then the cloth was spread. A person came with cheese, another came with dates, and still another came with refined butter, and they prepared hais and that was the wedding feast of Allah's Messenger (ﷺ)
Sahih Muslim Book 16, Hadith 99
The Prophet (ﷺ) said, "I will be standing at the Lake-Fount so that I will see whom among you will come
to me; and some people will be taken away from me, and I will say, 'O Lord, (they are) from me and
from my followers.' Then it will be said, 'Did you notice what they did after you? By Allah, they kept
on turning on their heels (turned as renegades).' " The sub-narrator, Ibn Abi Mulaika said, "O Allah,
we seek refuge with You from turning on our heels, or being put to trial in our religion."
Sahih al-Bukhari Book 81, Hadith 181
Yahya related to me from Malik from Ziyad ibn Sad that Ibn Shihab
said, "Neither jurur, nor musran al-fara, nor adhq ibn hubayq should
be taken as zakat from dates. They should be included in the
assessment but not taken as zakat. "
Malik said, "This is the
same as with sheep and goats, whose young are included in the
assessment but are not (actually) taken as zakat. There are also
certain kinds of fruit which are not taken as zakat, such as burdi
dates (one of the finest kinds of dates), and similar varieties.
Neither the lowest quality (of any property) nor the highest
should be taken. Rather, zakat should be taken from average quality
property."
Malik said, "The position that we are agreed upon
concerning fruit is that only dates and grapes are estimated while on
the tree. They are estimated when their usability is clear and they
are halal to sell. This is because the fruit of date-palms and vines
is eaten straightaway in the form of fresh dates and grapes, and so
the assessment is done by estimation to make things easier for people
and to avoid causing them trouble. Their produce is estimated and then
they are given a free hand in using their produce as they wish, and
later they pay the zakat on it according to the estimation that was
made."
Malik said, "crops which are not eaten fresh, such as
grains and seeds, which are only eaten after they have been harvested,
are not estimated. The owner, after he has harvested, threshed and
sifted the crop, so that it is then in the form of grain or seed, has
to fulfil his trust himself and deduct the zakat he owes if the amount
is large enough for him to have to pay zakat. This is the position
that we are all agreed upon here (in Madina)."
Malik said,
"The position that we are all agreed upon here (in Madina) is that the
produce of date palms is estimated while it is still on the tree,
after it has ripened and become halal to sell, and the zakat on it is
deducted in the form of dried dates at the time of harvest. If the
fruit is damaged after it has been estimated and the damage affects
all the fruit then no zakat has to be paid. If some of the fruit
remains unaffected, and this fruit amounts to five awsuq or more using
the sa of the Prophet, may Allah bless him and grant him peace, then
zakat is deducted from it. Zakat does not have to be paid, however, on
the fruit that was damaged . Grapevines are dealt with in the same
way.
If a man owns various pieces of property in various
places, or is a co-owner of various pieces of property in various
places, none of which individually comes to a zakatable amount, but
which, when added together, do come to a zakatable amount, then he
adds them together and pays the zakat that is due on them ."
Muwatta Malik Book 17, Hadith 37
Abu Hurairah said that a man came to the Messenger of Allah (ﷺ) and said: I saw (in my dream) a piece of cloud from which ghee and honey were dropping. I saw the people spreading their hands. Some of them took much and some a little. I also saw a rope hanging from Heaven to Earth. I saw, Messenger of Allah, that you caught hold of it and ascended by it. Then another man caught hold of it and ascended it. Then another man caught hold of it and ascended it. Then another man caught hold of it, but it broke, and then it was joined and he ascended it.
AbuBakr said: May my parents be sacrificed for you, if you allow, I shall interpret it.
He said: Interpret it. He said: The piece of cloud is the cloud of Islam; the ghee and honey that were dropping from it are the Quran, which contains softness and sweetness. Those who received much or little of it are those who learn much or little of the Quran. The rope hanging from Heaven to Earth is the truth which you are following. You catch hold of it and then Allah will raise you to Him. Then another man will catch hold of it and ascend it, Then another man will catch hold of it and it will break. But it will be joined and he will ascend it. Tell me. Messenger of Allah, whether I am right or wrong.
He said: You are partly right and partly wrong. He said: I adjure you by Allah, you should tell me where I am wrong.
The Prophet (ﷺ) said: Do not take an oath.
Sunan Abi Dawud Book 42, Hadith 37
Yahya said, "I heard Malik say that if a man pledges his garden
for a stated period and the fruits of that garden are ready before the
end of that period, the fruits are not included in the pledge with the
real estate, unless it is stipulated by the pledger in his pledge.
However, if a man receives a slave-girl as a pledge and she is
pregnant or she becomes pregnant after his taking her as a pledge, her
child is included with her.
"A distinction is made between
the fruit and the child of the slave-girl. The Messenger of Allah, may
Allah bless him and grant him peace, said, 'If someone sells a palm
which has been pollinated, the fruit belongs to the seller unless the
buyer stipulates its inclusion.' The undisputed way of doing things in
our community is that if a man sells a slave-girl or an animal with a
foetus in its womb, the foetus belongs to the buyer, whether or not
the buyer stipulates it. The palm is not like the animal. Fruit is not
like the foetus in its mother's womb. Part of what clarifies that is
also that it is the usage of people to have a man pawn the fruit of
the palm apart from the palm. No one pawns the foetus in its mother's
womb whether of slaves or animals."
Muwatta Malik Book 36, Hadith 18
We took part in the holy battle of Tabuk in the company of the Prophet (ﷺ) and when we arrived at the
Wadi-al-Qura, there was a woman in her garden. The Prophet (ﷺ) asked his companions to estimate the
amount of the fruits in the garden, and Allah's Messenger (ﷺ) estimated it at ten Awsuq (One Wasaq = 60
Sa's) and 1 Sa'= 3 kg. approximately). The Prophet (ﷺ) said to that lady, "Check what your garden will
yield." When we reached Tabuk, the Prophet (ﷺ) said, "There will be a strong wind tonight and so no one
should stand and whoever has a camel, should fasten it." So we fastened our camels. A strong wind
blew at night and a man stood up and he was blown away to a mountain called Taiy, The King of Aila
sent a white mule and a sheet for wearing to the Prophet (ﷺ) as a present, and wrote to the Prophet (ﷺ) that his
people would stay in their place (and will pay Jizya taxation.) (1) When the Prophet (ﷺ) reached Wadi-al-
Qura he asked that woman how much her garden had yielded. She said, "Ten Awsuq," and that was
what Allah's Messenger (ﷺ) had estimated. Then the Prophet (ﷺ) said, "I want to reach Medina quickly, and
whoever among you wants to accompany me, should hurry up." The sub-narrator Ibn Bakkar said
something which meant: When the Prophet (p.b.u.h) saw Medina he said, "This is Taba." And when
he saw the mountain of Uhud, he said, "This mountain loves us and we love it. Shall I tell you of the
best amongst the Ansar?" They replied in the affirmative. He said, "The family of Bani-n-Najjar, and
then the family of Bani Sa`ida or Bani Al-Harith bin Al-Khazraj. (The above-mentioned are the best)
but there is goodness in all the families of Ansar."
