Yahya related to me from Malik from Ishaq ibn Abdullah ibn Abi
Talha from Abu Murra, the mawla of Aqil ibn Abi Talib from Abu Waqid
al-Laythi that the Messenger of Allah, may Allah bless him and grant
him peace, was sitting in the mosque with some people when three
people came in. Two came toward the Messenger of Allah, may Allah
bless him and grant him peace, and one went away. When the two stopped
at the assembly of the Messenger of Allah, may Allah bless him and
grant him peace, they gave the greeting. One of them saw a gap in the
circle and sat in it. The other sat down behind the circle. The third
turned away and left. When the Messenger of Allah, may Allah bless him
and grant him peace, finished, he said, "Shall I tell you about three
people? One of them sought shelter with Allah, so Allah gave him
shelter. The other was shy, so Allah was shy to him. The other turned
away, so Allah turned away from him."
Muwatta Malik Book 53, Hadith 4
Yahya related to me from Malik from Abdullah ibn Abdullah ibn
Jabir ibn Atik that Atik ibn al-Harith, the grandfather of Abdullah
ibn Abdullah ibn Jabir on his mother's side, told him that Jabir ibn
Atik had told him that the Messenger of Allah, may Allah bless him and
grant him peace, came to visit Abdullah ibn Thabit and found him in
his death-throes. He called to him but he did not reply. The Messenger
of Allah, may Allah bless him and grant him peace, said, "We belong to
Allah, and to Him we are returning," and added, "You are being taken
from us, Abur-Rabi`." The women cried out and wept, and Jabir began
to silence them. The Messenger of Allah, may Allah bless him and grant
him peace, said, "Leave them, and when the necessary time comes, none
of the women should cry." They said, "Messenger of Allah, what is the
necessary time?" and he replied, "When he dies." The dying man's
daughter said, "By Allah, I hope that you will be a martyr, for you
have completed your preparations for battle," and the Messenger of
Allah, may Allah bless him and grant him peace, said, "Allah has made
his reward fall according to his intention. What do you consider dying
a martyr to be?" They said, "Death in the way of Allah." The Messenger
of Allah, may Allah bless him and grant him peace, said, "There are
seven kinds of martyr other than those killed in the way of Allah.
Someone who is killed by the plague is a martyr, someone who drowns is
a martyr, someone who dies of pleurisy is a martyr, someone who dies
of a disease of the belly is a martyr, someone who dies by fire is a
martyr, someone who dies under a falling building is a martyr and a
woman who dies in childbirth is a martyr."
Muwatta Malik Book 16, Hadith 37
Yahya related to me from Malik that it reached him that a slave
of Abdullah ibn Umar escaped and one of his horses wandered off, and
the idol worshippers seized them. Then the Muslims recaptured them,
and they were returned to Abdullah ibn Umar, before the division of
the spoils took place.
I heard Malik say about muslim
property that had been seized by the enemy, "If it is noticed before
the distribution, then it is returned to itsowner. Whatever has
already been distributed is not returned to anyone."
Malik,
when asked about a man whose young male slave was taken by the idol
worshippers and then the Muslims re-captured him, said, "The owner is
more entitled to him without having to pay his price or value or
having to incur any loss before the distribution takes place. If the
distribution has already taken place then I think that the slave
belongs to his master for his price if the master wants him back."
Regarding an umm walad of a Muslim man who has been taken by
the idol worshippers and then recaptured by the Muslims and allotted
in the distribution of spoils and then recognised by her master after
the distribution, Malik said, "She is not to be enslaved. I think that
the Imam should pay a ransom for her for her master. If he does not
do it, then her master must pay a ransom for her and not leave her. I
do not think that she should be made a slave by whoever takes her and
intercourse with her is not halal. She is in the position of a free
woman because her master would be required to pay compensation if she
injured somebody and so she is in the same position (as a wife). He
must not leave the mother of his son to be enslaved nor may
intercourse with her be made halal."
Malik was asked about a
man who went to enemy territory to pay ransom or to trade, and he
bought a free man or a slave, or they were given to him. He said, "As
for the free man, the price he buys him for is a debt against the man
and he is not made a slave. If the captive is given to him freely, he
is free and owes nothing unless the man gave something in recompense
for him. That is a debt against the free man, the same as if a ransom
had been paid for him. As for a slave, his former master can choose to
take him back and pay his price to the man who bought him or he can
choose to leave him, as he wishes. If he was given to the man, the
former master is more entitled to him, and he owes nothing for him
unless the man gave something for him in recompense. Whatever he gave
for him is a loss against the master if he wants him back."
Muwatta Malik Book 21, Hadith 19
Yahya related to me from Malik from Ibn Shihab that Umm Hakim
bint al-Harith ibn Hisham who was the wife of Ikrima ibn Abi Jahl
became muslim on the day of the conquest of Makka, and her husband
Ikrima fled from Islam as far as the Yemen. Umm Hakim set out after
him until she came to him in the Yemen and she called him to Islam,
and he became muslim. He went to the Messenger of Allah, may Allah
bless him and grant him peace, in the year of the conquest. When the
Messenger of Allah, may Allah bless him and grant him peace, saw him,
he rushed to him in joy and did not bother to put on his cloak until
he had made the pledge with him. They were confirmed in their
marriage.
Malik said, "If a man becomes muslim before his
wife, a separation occurs between them when he presents Islam to her
and she does not become muslim, because Allah, the Blessed, the
Exalted, said in His Book, 'Do not hold fast to the ties of women who
are kafirun.' "
Muwatta Malik Book 28, Hadith 50
I said to 'A'isha: I do not see any harm to me if I do not circumambulate betweez al-Safa' and al-Marwa. She said: On what ground do you say so? (I said: ) Since Allah, the Exalted and Majestic, says:" Verily al-Safa' and al-Marwa are among the Signs of Allah." It (your assertion) were (correct), it would have been said like this:" There is no harm for him, that he should not circumambulate between them." It (this verse) has been revealed about the people of Ansar. Whenever they pronounced the Talbiya, they pronounced it in the name of al-Manat during the Days of Ignorance; so they (thought) that it was not permissible for them (for the Muslims) to circumambulate between and al-Marwa. When they (the Muslims) came with Allah's Apostle (may peace he upon him) for Hajj, they mentioned it to him. So Allah, the Exalted and Majestic, revealed this verse. By my life, Allah will not complete the Hajj of one who has not circumambulated between al-Safa and al-Marwa.
Sahih Muslim Book 15, Hadith 286
When Allah's Apostle (ﷺ) married Zainab bint jahsh, he invited people (to the wedding feast) and they ate food. They then sat there and entered into conversation. He (the Holy Prophet) made a stir as if he was preparing to stand up, but (the persons busy in talking) did not stand up. When he (the Holy Prophet) saw it, he stood up and when he did so, some other persons stood up. 'Asim and Abd al-A'la in their narrations made this addition: Three (persons) sat there, and Allah's Apostle (ﷺ) came there to enter (the apartment) but he found the people sitting there. Then they stood up and went away. He said: Then I came and informed Allah's Apostle (ﷺ) that they had gone away. He (the Holy Prophet) then came there until he entered (the apartment). I also went and was about to enter, when he hung a curtain between me and him (and it was on this occasion that) Allah, the Exalted and Majestic, revealed this verse:" O you who believe, enter not the houses of the Prophet unless permission is given to you for a meal, not waiting for its cooking being finished to the (words)" Surely this is serious in the sight of Allah" (xxxiii. 53).
Sahih Muslim Book 16, Hadith 108
Yahya related to me from Malik from Ayyub ibn Abi Tamima as-
Sakhtayani from Muhammad ibn Sirin from Abu Hurayra that the Messenger
of Allah, may Allah bless him and grant him peace, finished the prayer
after two rakas and Dhu'l-Yadayn said to him, "Has the prayer been
shortened or have you forgotten, Messenger of Allah?" The Messenger of
Allah, may Allah bless him and grant him peace, said, "Has
Dhu'l-Yadayn spoken the truth?" The people said, "Yes," and the
Messenger of Allah, may Allah bless him and grant him peace, stood and
prayed the other two rakas and then said, "Peace be upon you." Then he
said, "Allah is greater" and went into a sadja as long as his usual
prostrations or longer. Then he came up and said, "Allah is greater"
and went into a sajda as long as his usual prostrations or longer and
then came up.
Muwatta Malik Book 3, Hadith 62
Yahya related to me from Malik from Abd ar-Rahman ibn al-Qasim
from his father that A'isha said, "I came to Makka at the time of my
period so I did not do tawaf of the House or go between Safa and
Marwa. I complained to the Messenger of Allah, may Allah bless him and
grant him peace, and he said, 'Do what the people doing hajj do except
do not do tawaf of the House and go between Safa and Marwa until you
are pure.' "
Malik said, concerning a woman who entered ihram
for umra at the time of hajj, and she arrived in Makka during her
period and so could not do tawaf of the House, "When she fears that
the time (for hajj) is getting close, she gets into ihram for the hajj
and sacrifices an animal. She is like someone who combines the hajj
and the umra. One tawaf is enough for her. If a women starts her
period after she has already done tawaf of the House and prayed, she
does say between Safa and Marwa and stops at Arafa and Muzdalifa and
stones the jamras but she does not do the tawaf al-ifada until she is
pure and has finished her menses."
Muwatta Malik Book 20, Hadith 236
Yahya related to me from Malik from Abu'z Zubayr al-Makki from
Tawus al-Yamani from Abdullah ibn Abbas that the Messenger of Allah,
may Allah bless him and grant him peace, used to say, when he rose for
prayer in the middle of the night, "O Allah, praise belongs to You.
You are the light of the heavens and the earth and praise belongs
toYou.You are the Sustainer of the heavens and the earth and praise
belongs to You. You are the Lord of the heavens and the earth and
whoever is in them. You are the Truth, and Your words are true. Your
promise is true, and the meeting with You is true. The Garden is true
and the Fire is true and the Hour is true. O Allah, I submit toYou and
I accept You and I trust in You and I turn to You and I argue by You
and I summon toYou for judgement. Forgive me what I have sent before
me and what I have left behind, what I have kept secret and what I
have proclaimed, You are my god - there is no god but You."

Muwatta Malik Book 15, Hadith 36
`Abdullah bin Mas`ud said, "While Allah's Messenger (ﷺ) was praying beside the Ka`ba, there were some
Quraish people sitting in a gathering. One of them said, 'Don't you see this (who does deeds just to
show off)? Who amongst you can go and bring the dung, blood and the Abdominal contents
(intestines, etc.) of the slaughtered camels of the family of so and so and then wait till he prostrates
and put that in between his shoulders?' The most unfortunate amongst them (`Uqba bin Abi Mu'ait)
went (and brought them) and when Allah's Messenger (ﷺ) prostrated, he put them between his shoulders. The
Prophet remained in prostration and they laughed so much so that they fell on each other. A passerby
went to Fatima, who was a young girl in those days. She came running and the Prophet (ﷺ) was still in
prostration. She removed them and cursed upon the Quraish on their faces. When Allah's Messenger (ﷺ)
completed his prayer, he said, 'O Allah! Take revenge on Quraish.' He said so thrice and added, 'O
Allah! take revenge on `Amr bin Hisham, `Utba bin Rabi`a, Shaiba bin Rabi`a, Al-Walid bin `Utba,
Umaiya bin Khalaf, `Uqba bin Abi Mu'ait and `Umar a bin Al-Walid." `Abdullah added, "By Allah! I
saw all of them dead in the battle field on the day of Badr and they were dragged and thrown in the
Qalib (a well) at Badr: Allah's Messenger (ﷺ) then said, 'Allah's curse has descended upon the people of the
Qalib (well).
Sahih al-Bukhari Book 8, Hadith 167
That 'Abd Allah b. Abbas, 'Abd al-Rahman b. Azhar and al-Miswar b. Makhramah sent him to 'Aishah, wife of the Prophet (ﷺ). They said: Convey our regards to her from all of us and ask her about the two rak'ahs after the 'Asr prayer, and tell her that we have been informed that she prays them, and we are told that the Messenger of Allah (ﷺ) prohibited them. I entered upon her and told her that for which they had sent me to her. She said: Ask Umm Salamah. I returned to them (Ibn 'Abbas and others) and informed them about her opinion. They sent me back to Umm Salamah with the same mission for which they had sent me to 'Aishah. Umm Salamah said: I heard the Messenger of Allah (ﷺ) prohibiting them, but later on I saw him praying them. When he prayed them, he had offered the 'Asr prayer. He then came to me while a number of women from Banu Haram from the Ansar were sitting with me. He prayed these two rak'ahs. I sent a slave girl to him and I told her: Stand beside him and tell him that Umm Salamah has asked: Messenger of Allah (ﷺ), I heard you prohibiting these two rak'ahs (after the afternoon prayer) but I see you praying them yourself. If he makes a sign with his hand, step backward from him. The slave girl did so. When he finished prayer, he said: O daughter of Abu Umayyah, you asked about the praying of two rak'ahs after the 'Asr prayer, in fact, some people of 'Abd al-Qais has come to me with the news that their people had embraced Islam. They hindered me from praying the two rak'ahs after Zuhr prayer. It is those two rak'ahs (which I offered after the 'Asr prayer)
Sunan Abi Dawud Book 5, Hadith 24
We were sitting in the company of Hudhaifa. A man said: If I were in the time of the Messenger of Allah (ﷺ), I would have fought by his side and would have striven hard for his causes. Hudhaifa said: You might have done that, (but you should not make a flourish of your enthusiasm). I was with the Messenger of Allah (ﷺ) on the night of the Battle of Abzib and we were gripped by a violent wind and severe cold. The Messenger of Allah (may peace be him) said: Hark, the man who (goes reconnoitring and) brings me the news of the enemy shall be ranked with me on the Day of Judgment by Allah (the Glorious and Exalted). We all kept quiet and none of us responed to him. (Again) he said: Hark, a man who (goes reconnoitring and) brings me the news of the enemy shall be ranked with me on the Day of Judgment by Allah (the Glorious and Exalted). We kept quiet and none of us responded to him. He again said: Hark, a man who (goes reconnoitring and) brings me the news of the enemy shall be ranked with me on the Day of Judgtuent by Allah (the Glorious and Exalted) Then he said: Get up Hudhaifa, bring me the news of the enemy. When he called me by name I had no alternative but to get up. He said: Go and bring me information about the enemy, and do nothing that may provoke them against me. When I left him, I felt warm as if I were walking in a heated bath untill I reached them. I saw Abu Sufyan warming his back against fire I put an arrow in the middle of the bow. intending to shoot at him, when I recalled the words of the Messenger of Allah (ﷺ)" Do not provoke them against me." Had I shot at him, I would have hit him. But I returned and (felt warm as if) I were walking in a heated bath (hammam). Presenting myself before him, I gave him information about the enemy. When I had done so, I began to feel cold, so the Messenger of Allah (ﷺ) wrapped me in a blanket that he had in excess to his own requirement and with which he used to cover himself while saying his prayers. So I continued to sleep until it was morning. When it was morning he said: Get up, O heavy sleeper.
Sahih Muslim Book 32, Hadith 122
Ya`la bin Muslim and `Amr bin Dinar and some others narrated the narration of Sa`id bin Jubair.
Narrated Sa`id: While we were at the house of Ibn `Abbas, Ibn `Abbas said, "Ask me (any question)" I
said, "O Abu `Abbas! May Allah let me be sacrificed for you ! There is a man at Kufa who is a storyteller
called Nauf; who claims that he (Al-Khadir's companion) is not Moses of Bani Israel." As for
`Amr, he said to me, "Ibn `Abbas said, "(Nauf) the enemy of Allah told a lie." But Ya`la said to me,
"Ibn `Abbas said, Ubai bin Ka`b said, Allah's Messenger (ﷺ) said, 'Once Moses, Allah's Messenger (ﷺ), preached to
the people till their eyes shed tears and their hearts became tender, whereupon he finished his sermon.
Then a man came to Moses and asked, 'O Allah's Messenger (ﷺ)! Is there anyone on the earth who is more
learned than you?' Moses replied, 'No.' So Allah admonished him (Moses), for he did not ascribe all
knowledge to Allah. It was said, (on behalf of Allah), 'Yes, (there is a slave of ours who knows more
than you ).' Moses said, 'O my Lord! Where is he?' Allah said, 'At the junction of the two seas.' Moses
said, 'O my Lord ! Tell I me of a sign whereby I will recognize the place.' " `Amr said to me, Allah
said, "That place will be where the fish will leave you." Ya`la said to me, "Allah said (to Moses),
'Take a dead fish (and your goal will be) the place where it will become alive.' " So Moses took a fish
and put it in a basket and said to his boy-servant "I don't want to trouble you, except that you should
inform me as soon as this fish leaves you." He said (to Moses)." You have not demanded too much."
And that is as mentioned by Allah:
'And (remember) when Moses said to his attendant .... ' (18.60) Yusha` bin Noon. (Sa`id did not state
that). The Prophet (ﷺ) said, "While the attendant was in the shade of the rock at a wet place, the fish
slipped out (alive) while Moses was sleeping. His attend an said (to himself), "I will not wake him, but
when he woke up, he forgot to tell him The fish slipped out and entered the sea. Allah stopped the
flow of the sea. where the fish was, so that its trace looked as if it was made on a rock. `Amr forming
a hole with his two thumbs an index fingers, said to me, "Like this, as in its trace was made on a
rock."
Moses said "We have suffered much fatigue on this journey of ours." (This was not narrated by Sa`id).
Then they returned back and found Al-Khadir. `Uthman bin Abi Sulaiman said to me, (they found
him) on a green carpet in the middle of the sea. Al-Khadir was covered with his garment with one end
under his feet and the other end under his head. When Moses greeted, he uncovered his face and said
astonishingly, 'Is there such a greeting in my land? Who are you?' Moses said, 'I am Moses.' Al-
Khadir said, 'Are you the Moses of Bani Israel?' Moses said, 'Yes.' Al-Khadir said, "What do you
want?' Moses said, ' I came to you so that you may teach me of the truth which you were taught.' Al-
Khadir said, 'Is it not sufficient for you that the Torah is in your hands and the Divine Inspiration
comes to you, O Moses? Verily, I have a knowledge that you ought not learn, and you have a
knowledge which I ought not learn.' At that time a bird took with its beak (some water) from the sea:
Al-Khadir then said, 'By Allah, my knowledge and your knowledge besides Allah's Knowledge is like
what this bird has taken with its beak from the sea.' Until, when they went on board the boat (18.71).
They found a small boat which used to carry the people from this sea-side to the other sea-side. The
crew recognized Al-Khadir and said, 'The pious slave of Allah.' (We said to Sa`id "Was that Khadir?"
He said, "Yes.") The boat men said, 'We will not get him on board with fare.' Al-Khadir scuttled the
boat and then plugged the hole with a piece of wood.
Moses said, 'Have you scuttled it in order to drown these people surely, you have done a dreadful thing.
(18.71) (Mujahid said. "Moses said so protestingly.") Al-Khadir said, didn't I say that you can have no
patience with me?' (18.72) The first inquiry of Moses was done because of forgetfulness, the second
caused him to be bound with a stipulation, and the third was done intentionally. Moses said, 'Call
me not to account for what I forgot and be not hard upon me for my affair (with you).' (18.73)
(Then) they found a boy and Al-Khadir killed him. Ya`la- said: Sa`id said 'They found boys playing
and Al-Khadir got hold of a handsome infidel boy laid him down and then slew him with knife. Moses
said, 'Have you killed a innocent soul who has killed nobody' (18.74) Then they proceeded and found
a wall which was on the point of falling down, and Al-Khadir set it up straight. Sa`id moved his hand
thus and said 'Al-Khadir raised his hand and the wall became straight. Ya`la said, 'I think Sa`id said,
'Al-Khadir touched the wall with his hand and it became straight (Moses said to Al-Khadir), 'If you
had wished, you could have taken wages for it.' Sa`id said, 'Wages that we might had eaten.' And there
was a king in furor (ahead) of them" (18.79) And there was in front of them. Ibn `Abbas recited: 'In
front of them (was) a king.'
It is said on the authority of somebody other than Sa`id that the king was Hudad bin Budad. They say
that the boy was called Haisur. 'A king who seized every ship by force. (18.79) So I wished that if that
boat passed by him, he would leave it because of its defect and when they have passed they would
repair it and get benefit from it. Some people said that they closed that hole with a bottle, and some
said with tar. 'His parents were believers, and he (the boy) was a non-believer and we (Khadir) feared
lest he would oppress them by obstinate rebellion and disbelief.' (18.80) (i.e. that their love for him
would urge them to follow him in his religion, 'so we (Khadir) desired that their Lord should change
him for them for one better in righteousness and near to mercy' (18:81). This was in reply to Moses'
saying: Have you killed an innocent soul.'? (18.74). 'Near to mercy" means they will be more merciful
to him than they were to the former whom Khadir had killed. Other than Sa`id, said that they were
compensated with a girl. Dawud bin Abi `Asim said on the authority of more than one that this next
child was a girl.
Sahih al-Bukhari Book 65, Hadith 248
"O Messenger of Allah, this man killed my brother." The Messenger of Allah said to him: "Did you kill him?" He said: "O Messenger of Allah even if he did not confess I would have brought proof against him." He said: "Yes, I killed him." He said: "How did you kill him?" He said: "He and I were chopping firewood from a tree and he insulted me, so I got angry and struck him with the ax on the forehead." The Messenger of Allah said: "Do you have any wealth with which you can pay the Diyah to save yourself?" He said: "O Messenger of Allah, I do not have anything but my ax and my clothes." The Messenger of Allah said to him: "Do you think your people will pay to save you?" He said: "I am too insignificant to them for that." He threw the string to the man and said: "Here, thank him." When he turned to go, the Messenger of Allah said: "If he kills him, he will be like him. "They caught up with the man, and said: "Woe to you! The Messenger of Allah said: 'If he kills him, he will be like him. "So he went back to the Messenger of Allah and said: "O Messenger of Allah, I have been told that you said: 'if he kills him, he will be like him. 'But I only took him because you told me to. He said: 'Don't you want him to carry your sin and the sin of your companion (the victim)?' He said: 'Yes, if that is the case.' He said: 'And that is how it is."'
Sunan an-Nasa'i Book 45, Hadith 22
I went to the Prophet (ﷺ) while two men who were Ash’ arIs were with me. One of them was on my right and the other on my left side. Bothe of them asked him for employment. The prophet (ﷺ) was silent. He asked : What do you say Abu Musa, or ‘Abd Allah b. Qais (Abu Musa’s name)? I replied: By him who has sent you with truth, they did not inform me of what they had in their hearts, and I did not know that they would ask for an employment. He said : I have the scene before my eyes that he had his toothstick below his lip which receded. He (the prophet) said: We will never or will not put in charge of our work anyone who asks for it. But go, ye, Abu Musa, or ‘Abd Allah b. Qais. He then sent him as a Governor of the Yemen, After him he sent Muadh b. Jabal. When Muadh came to him, he said: come down , and he put a cushion for him. He saw that a man was chained with him. He asked : What is this? He replied: He was a Jew and he accepted Islam. He then converted to his religion, an evil religion. He said: I will not sit until he is killed according to the decision of Allah and his Apostle (ﷺ). He said: Yes, be seated. He said: I will not sit until he is killed according to the decision of Allah and his Apostle (peace be upon him). He said it three times. He then commanded for it and he was killed. Both of them then discussed the question of prayer and vigilance at night. One of them, probably Muadh, said : So far as I am concerned, I sleep and I keep vigilance: I keep vigilance and I sleep: I hope for the same reward for my sleep as for my vigilance.
Sunan Abi Dawud Book 40, Hadith 4
I heard Allah's Messenger (ﷺ) while he was standing on the pulpit, saying, "The remaining period of your
stay (on the earth) in comparison to the nations before you, is like the period between the `Asr prayer
and sunset. The people of the Torah were given the Torah and they acted upon it till midday, and then
they were worn out and were given for their labor, one Qirat each. Then the people of the Gospel were
given the Gospel and they acted upon it till the time of the `Asr prayer, and then they were worn out
and were given (for their labor), one Qirat each. Then you people were given the Qur'an and you acted
upon it till sunset and so you were given two Qirats each (double the reward of the previous nations)."
Then the people of the Torah said, 'O our Lord! These people have done a little labor (much less than
we) but have taken a greater reward.' Allah said, 'Have I withheld anything from your reward?' They
said, 'No.' Then Allah said, 'That is My Favor which I bestow on whom I wish.' "
Sahih al-Bukhari Book 97, Hadith 93
