(from the companions of Allah's Messenger (ﷺ)) When Suhail bin `Amr agreed to the Treaty (of Hudaibiya),
one of the things he stipulated then, was that the Prophet (ﷺ) should return to them (i.e. the pagans)
anyone coming to him from their side, even if he was a Muslim; and would not interfere between
them and that person. The Muslims did not like this condition and got disgusted with it. Suhail did not
agree except with that condition. So, the Prophet (ﷺ) agreed to that condition and returned Abu Jandal to
his father Suhail bin `Amr. Thenceforward the Prophet (ﷺ) returned everyone in that period (of truce)
even if he was a Muslim. During that period some believing women emigrants including Um Kulthum
bint `Uqba bin Abu Muait who came to Allah's Messenger (ﷺ) and she was a young lady then. Her relative
came to the Prophet (ﷺ) and asked him to return her, but the Prophet (ﷺ) did not return her to them for Allah
had revealed the following Verse regarding women:
"O you who believe! When the believing women come to you as emigrants. Examine them, Allah
knows best as to their belief, then if you know them for true believers, Send them not back to the
unbelievers, (for) they are not lawful (wives) for the disbelievers, Nor are the unbelievers lawful
(husbands) for them (60.10)
Sahih al-Bukhari Book 54, Hadith 1
"Shall I not tell you about the Prophet and I?" We said: "Yes." She said: "When it was my night, he came in, placed his shoes by his feet, lay down his Rida' (upper garment), and spread his Izar (lower garment) on his bed. As soon as he thought that I had gone to sleep, he put his shoes on slowly and picked up his Rida' slowly. Then he opened the door slowly, went out and shut it slowly. I put my garment over my head, covered myself and put on my Izar (lower garment), and I set out after him until he came to Al-Baqi', raised his hands three times and stood there for a long time. Then he left and I left, he hurried and I hurried, he ran and I ran, and I got there before him and entered (the house). I had only just laid down when he came in and said: 'O 'Aishah, why are you out of breath?' (one of the reporters) Sulaiman said: I thought he (Ibn Wahb) said: 'short of breath.' He said: 'Either you tell me or the All-Aware, All-Knowing will tell me.' I said: 'O Messenger of Allah, may my father and mother be sacrificed for you;' and I told him the story. He said: 'You were the black shape I saw in front of me?' I said: 'Yes.'" She said: "He gave me a shove in the chest that hurt me and said: 'You thought that Allah and His Messenger would be unfair to you.' She said: 'Whatever people conceal, Allah, the Mighty and Sublime, knows it.' He said: 'Yes.' He said: 'Jibril came to me when you saw (me leave) but he did not enter upon you because you have taken off your garments. So he called me but he concealed himself from you, and I answered him but I concealed it from you. I thought that you had gone to sleep and I did not want to wake you and I was afraid that you would feel lonely. He told me to go to Al-Baqi' and pray for forgiveness for them.'"
Hajjaj bin Muhammad contradicted him (Ibn Wahb), he said: "From Ibn Juraij, from Ibn Abi Mulaikah, from Muhammad bin Qais."
Sunan an-Nasa'i Book 36, Hadith 25
Anas bin Malik said, "A person entered the Mosque on a Friday through the gate facing the Daril-
Qada' and Allah's Messenger (ﷺ) was standing delivering the Khutba (sermon). The man stood in front of
Allah's Messenger (ﷺ) and said, 'O Allah's Messenger (ﷺ), livestock are dying and the roads are cut off; please pray
to Allah for rain.' So Allah's Messenger (ﷺ) (p.b.u.h) raised both his hands and said, 'O Allah! Bless us with
rain. O Allah! Bless us with rain. O Allah! Bless us with rain!" Anas added, "By Allah, there were no
clouds in the sky and there was no house or building between us and the mountain of Sila'. Then a big
cloud like a shield appeared from behind it (i.e. Silas Mountain) and when it came in the middle of the
sky, it spread and then rained. By Allah! We could not see the sun for a week. The next Friday, a
person entered through the same gate and Allah's Messenger (ﷺ) was delivering the Friday Khutba and the
man stood in front of him and said, 'O Allah's Messenger (ﷺ)! The livestock are dying and the roads are cut
off; Please pray to Allah to withhold rain.' " Anas added, "Allah's Messenger (ﷺ) raised both his hands and
said, 'O Allah! Round about us and not on us. O Allah!' On the plateaus, on the mountains, on the
hills, in the valleys and on the places where trees grow.' " Anas added, "The rain stopped and we came
out, walking in the sun." Sharik asked Anas whether it was the same person who had asked for rain
the previous Friday. Anas replied that he did not know.
Sahih al-Bukhari Book 15, Hadith 9
Yahya related to me from Malik that he had heard that the people
of knowledge did not disapprove of people fasting using tooth-sticks
at any hour of the day in Ramadan, whether at the beginning or the
end, nor had he heard any of the people of knowledge disapproving of
or forbidding the practice.
Yahya said that he heard Malik
say, about fasting for six days after breaking the fast at the end of
Ramadan, that he had never seen any of the people of knowledge and
fiqh fasting them. He said, "I have not heard that any of our
predecessors used to do that, and the people of knowledge disapprove
of it and they are afraid that it might become a bida and that common
and ignorant people might join to Ramadan what does not belong to it,
if they were to think that the people of knowledge had given
permission for that to be done and were seen doing it.
Yahya
said that he heard Malik say, "I have never heard any of the people of
knowledge and fiqh and those whom people take as an example forbidding
fasting on the day of jumua. Fasting on it is good, and I have seen
one of the people of knowledge fasting it, and it seemed to me that he
was keen to do so."
