The Prophet (ﷺ) said (on the day of Idal-Adha), "The first thing we will do on this day of ours, is to offer
the (`Id) prayer and then return to slaughter the sacrifice. Whoever does so, he acted according to our
Sunna (tradition), and whoever slaughtered (the sacrifice) before the prayer, what he offered was just
meat he presented to his family, and that will not be considered as Nusak (sacrifice)." (On hearing
that) Abu Burda bin Niyar got up, for he had slaughtered the sacrifice before the prayer, and said, "I
have got a six month old ram." The Prophet (ﷺ) said, 'Slaughter it (as a sacrifice) but it will not be
sufficient for any-one else (as a sacrifice after you). Al-Bara' added: The Prophet (ﷺ) said, "Whoever
slaughtered (the sacrifice) after the prayer, he slaughtered it at the right time and followed the tradition
of the Muslims."
Sahih al-Bukhari Book 73, Hadith 1
Yahya related to me from Malik from Ibn Shihab from Urwa ibn az-
Zubayr from A'isha, umm al-muminin, that she took Hafsa ibn Abd ar-
Rahman ibn Abi Bakr as-Siddiq into her house when she had entered the
third period of her idda. Ibn Shihab said, "That was mentioned to Amra
bint Abd ar-Rahman, and she said that Urwa had spoken the truth and
people had argued with A'isha about it. They said that Allah, the
Blessed, the Exalted, said in His Book, 'Three quru.' A'isha said,
'You spoke the truth. Do you know what quru are? Quru are times of
becoming pure after menstruation .' "
Muwatta Malik Book 29, Hadith 60
"I heard Ibn Abi Mulaikah say: 'When Umm Aban died, I attended with the people. I sat in front of 'Abdullah bin 'Umar and Ibn 'Abbas, and the women wept. Ibn 'Umar said: 'Why don't you tell them not to weep? For I heard the Messenger of Allah say: The deceased is punished due to some of his family's weeping for him."' Ibn 'Abbas said: "Umar used to narrate something like that. I went out with 'Umar and when we got to on uninhabited area, he saw a caravan beneath a tree. He said: 'See whose caravan this is.' I went and I found Suhaib and his family. I came back to him and said: 'O Commander of the Believers! This is Suhaib and his family.' He said: 'Bring Suhaib to me.' When we entered Al-Madinah, 'Umar was attacked and Suhaib sat by him, weeping and saying, 'O my brother, O my brother.' 'Umar said: 'O Suhaib, do not weep, for I heard the Messenger of Allah say: The deceased is punished due to some of the weeping of his family for him. He said: I mentioned that to 'Aishah and she said: 'By Allah you are not narrating this Hadith from two liars who have disbelieved, but sometimes you mishear. And no bearer of burdens shall bear another's burden. And the Messenger of Allah said: 'Allah increases the punishment of the disbeliever because of his family's weeping for him."'
Sunan an-Nasa'i Book 21, Hadith 41
`Urwa bin Az-Zubair said that he asked `Aisha about the meaning of the Quranic Verse:--
"And if you fear that you will not deal fairly with the orphan girls then marry (other) women of your
choice." (4.2-3)
Aisha said, "It is about a female orphan under the guardianship of her guardian who is inclined
towards her because of her beauty and wealth, and likes to marry her with a Mahr less than what is
given to women of her standard. So they (i.e. guardians) were forbidden to marry the orphans unless
they paid them a full appropriate Mahr (otherwise) they were ordered to marry other women instead of
them. Later on the people asked Allah's Messenger (ﷺ) about it. So Allah revealed the following Verse:--
"They ask your instruction (O Muhammad!) regarding women. Say: Allah instructs you regarding
them..." (4.127)
and in this Verse Allah indicated that if the orphan girl was beautiful and wealthy, her guardian would
have the desire to marry her without giving her an appropriate Mahr equal to what her peers could get,
but if she was undesirable for lack of beauty or wealth, then he would not marry her, but seek to marry
some other woman instead of her. So, since he did not marry her when he had no inclination towards
her, he had not the right to marry her when he had an interest in her, unless he treated her justly by
giving her a full Mahr and securing all her rights.
