Abu Huraira said, "You people claim that Abu Huraira narrates many narrations of Allah's Messenger (ﷺ).
(Anyhow) with Allah will be our appointment. I was a poor man, and used to stick to Allah's Messenger (ﷺ)
contented with what will fill my stomach, and the Muhajirin (emigrants) used to be busy trading in the
markets, and the Ansar used to be busy looking after their properties. One-day I heard Allah's Messenger (ﷺ)
saying, 'Who will spread his Rida' (a garment covering the upper part of the body) till I finished my
speech and then fold it, (i.e. wrap it over your body), in which case he will never forget anything he
had heard from me." So I spread my garment which I was wearing; and by Him Who sent Muhammad
with the Truth, ever since, I have never forgotten whatever I heard from him (the Prophet)" (See,
Hadith No. 119, Vol. 1)
Sahih al-Bukhari Book 96, Hadith 81
Yahya related to me from Malik that Yahya ibn Said said, "Once
Muhammad ibn Yahya ibn Habban and I were sitting down, and Muhammad
called a man over to him and said to him, 'Tell me what you have heard
from your father.' The man replied that his father had told him that
he went to Zayd ibn Thabit and asked him, 'What do you think of
reciting the whole Quran in seven days?' Zayd said, 'That's good,
but I prefer to recite it in two weeks, or ten days. Ask me why that
is.' He said, 'I ask you then.' Zayd said, 'So that I can reflect on
it and pause in it.' "
Muwatta Malik Book 15, Hadith 5
Malik said, "When a man owes money to another man and he asks him
to let it stay with him as a quirad, that is disapproved of until the
creditor receives his property. Then he can make it a qirad loan or
keep it. That is because the debtor may be in a tight situation, and
want to delay it to increase it for him."
Malik spoke about
an investor who made a qirad loan to a man, and some of the principal
was lost before he used it, and then he used it and made a profit. The
agent wanted to make the principal the remainder of the money after
what was lost from it. Malik said, "His statement is not accepted, and
the principal is made up to its original amount from his profit. Then
they divide what remains after the principal has been repaid according
to the conditions of the qirad."
Malik said, "Qirad loan is
only good in gold or silver coin and it is never permitted in any kind
of wares or goods or articles."
Malik said, "There are
certain transactions which if a long span of time passes after the
transaction takes place, its revocation becomes unacceptable. As for
usury, there is never anything except its rejection whether it is a
little or a lot. What is permitted in other than it is not permitted
in it because Allah, the Blessed and the Exalted, said in His Book,
'If you repent, you have your capital back, not wronging and not
wronged. ' "
32.4 Conditions Permitted in Qirad
Muwatta Malik Book 32, Hadith 4
Allah's Messenger (ﷺ) said, "A man who never did any good deed, said that if he died, his family should burn
him and throw half the ashes of his burnt body in the earth and the other half in the sea, for by Allah,
if Allah should get hold of him, He would inflict such punishment on him as He would not inflict on
anybody among the people. But Allah ordered the sea to collect what was in it (of his ashes) and
similarly ordered the earth to collect what was in it (of his ashes). Then Allah said (to the recreated
man ), 'Why did you do so?' The man replied, 'For being afraid of You, and You know it (very well).'
So Allah forgave him."
Sahih al-Bukhari Book 97, Hadith 131
Allah, the brother of Abu Al-Qu'ais asked my permission to enter after the verses of Al-Hijab (veiling
the ladies) was revealed, and I said, "By Allah, I will not admit him unless I take permission of Allah's
Apostle for it was not the brother of Al-Qu'ais who had suckled me, but it was the wife of Al-Qu'ais,
who had suckled me." Then Allah's Messenger (ﷺ) entered upon me, and I said, "O Allah's Messenger (ﷺ)! The man
has not nursed me but his wife has nursed me." He said, "Admit him because he is your uncle (not
from blood relation, but because you have been nursed by his wife), Taribat Yaminuki." `Urwa said,
"Because of this reason, ' Aisha used to say: Foster suckling relations render all those things
(marriages etc.) illegal which are illegal because of the corresponding blood relations." (See Hadith
