Yahya related to me from Malik from Yahya ibn Said from Bushayr
ibn Yasar, the mawla of the Bani Haritha, that Suwayd ibn anNuman told
him that he went with the Messenger of Allah, may Allah bless him and
grant him peace, on the expedition to Khaybar. When they reached as
Suhba, which was near Khaybar, the Messenger of Allah, may Allah bless
him and grant him peace, stopped and prayed asr. He asked for
provisions but only parched barley was brought, so he asked for it to
be moistened. The Messenger of Allah, may Allah bless him and grant
him peace, ate and the people ate with him. Then he got up to do
maghrib and rinsed his mouth out and they rinsed out theirs. Then he
prayed without doing wudu.

Jami` at-Tirmidhi Book 48, Hadith 138
My father set out (for Mecca) in the year of Al-Hudaibiya, and his companions assumed Ihram, but he
did not. At that time the Prophet (ﷺ) was informed that an enemy wanted to attack him, so the Prophet (ﷺ)
proceeded onwards. While my father was among his companions, some of them laughed among
themselves. (My father said), "I looked up and saw an onager. I attacked, stabbed and caught it. I then
sought my companions' help but they refused to help me. (Later) we all ate its meat. We were afraid
that we might be left behind (separated) from the Prophet (ﷺ) so I went in search of the Prophet (ﷺ) and made
my horse to run at a galloping speed at times and let it go slow at an ordinary speed at other times till I
met a man from the tribe of Bani Ghifar at midnight. I asked him, "Where did you leave the Prophet (ﷺ)
?" He replied, "I left him at Ta'hun and he had the intention of having the midday rest at As-Suqya. I
followed the trace and joined the Prophet (ﷺ) and said, 'O Allah's Messenger (ﷺ)! Your people (companions)
send you their compliments, and (ask for) Allah's Blessings upon you. They are afraid lest they may
be left behind; so please wait for them.' I added, 'O Allah's Messenger (ﷺ)! I hunted an onager and some of
its meat is with me. The Prophet (ﷺ) told the people to eat it though all of them were in the state of
Ihram."
Sahih al-Bukhari Book 28, Hadith 1
Allah's Messenger, will we be able to see our Lord on the Day of Judgment? He said: Do you feel any difficulty in seeing the sun in the noon when there is no cloud over it? They said: No. He again said: Do you feel any difficulty in seeing the moon on the fourteenth night when there is no cloud over it? They said: No. Thereupon he said: By Allah Who is One in Whose Hand is my life. you will not face any difficulty in seeing your Lord but only so much as you feel in seeing one of them. Then Allah would sit in judgment upon the servant and would say: O, so and so, did I not honour you and make you the chief and provide you the spouse and subdue for you horses, camels, and afforded you an opportunity to rule over your subjects? He would say: Yes. And then it would be said: Did you not think that you would meet Us? And he would say: No. Thereupon He (Allah) would say: Well, We forget you as you forgot Us. Then the second person would be brought for judgment. (And Allah would) say: 0, so and so. did We not honour you and make you the chief and make you pair and subdue for you horses and camels and afford you an opportunity to rule over your subjects? He would say: Yes, my Lord. And He (the Lord) would say: Did you not think that you would be meeting Us? And he would say: No. And then He (Allah) would say: Well, I forget you today as you forgot Us. Then the third -one would be brought and He (Allah) would say to him as He said before. And he (the third person) would say: O, my Lord, I affirmed my faith in Thee and in Thy Book and in Thy Messenger and I observed prayer and fasts and gave charity, and he would speak in good terms like this as he would be able to do. And He (Allah) would say: Well, We will bring our witnesses to you. And the man would think in his mind who would bear witness upon him and then his mouth would be sealed and it would be said to his thighs, to his flesh and to his bones to speak and his thighs. flesh and bones would bear witness to his deeds and it would be done so that he should not be able to make any excuse for himself and he would be a hypocrite and Allah would be annoyed with him.
Sahih Muslim Book 55, Hadith 22
Yahya related to me from Malik from Nafi that Abdullah ibn Umar
divorced his wife while she was menstruating in the time of the
Messenger of Allah, may Allah bless him and grant him peace, Umar ibn
al-Khattab asked the Messenger of Allah, may Allah bless him and grant
him peace, about it. The Messenger of Allah, may Allah bless him and
grant him peace, said, "Go and tell him to take her back and keep her
until she is purified and then has a period and then is purified. Then
if he wishes, he an keep her, and if he wishes he should divorce her
before he has intercourse with her. That is the idda which Allah has
commanded for women who are divorced."
Muwatta Malik Book 29, Hadith 59
The first lady to use a girdle was the mother of Ishmael. She used a girdle so that she might hide her
tracks from Sarah. Abraham brought her and her son Ishmael while she was suckling him, to a place
near the Ka`ba under a tree on the spot of Zamzam, at the highest place in the mosque. During those
days there was nobody in Mecca, nor was there any water So he made them sit over there and placed
near them a leather bag containing some dates, and a small water-skin containing some water, and set
out homeward. Ishmael's mother followed him saying, "O Abraham! Where are you going, leaving us
in this valley where there is no person whose company we may enjoy, nor is there anything (to
enjoy)?" She repeated that to him many times, but he did not look back at her Then she asked him,
"Has Allah ordered you to do so?" He said, "Yes." She said, "Then He will not neglect us," and
returned while Abraham proceeded onwards, and on reaching the Thaniya where they could not see
him, he faced the Ka`ba, and raising both hands, invoked Allah saying the following prayers:
'O our Lord! I have made some of my offspring dwell in a valley without cultivation, by Your Sacred
House (Ka`ba at Mecca) in order, O our Lord, that they may offer prayer perfectly. So fill some hearts
among men with love towards them, and (O Allah) provide them with fruits, so that they may give
thanks.' (14.37) Ishmael's mother went on suckling Ishmael and drinking from the water (she had).
When the water in the water-skin had all been used up, she became thirsty and her child also became
thirsty. She started looking at him (i.e. Ishmael) tossing in agony; She left him, for she could not
endure looking at him, and found that the mountain of Safa was the nearest mountain to her on that
land. She stood on it and started looking at the valley keenly so that she might see somebody, but she
could not see anybody. Then she descended from Safa and when she reached the valley, she tucked up
her robe and ran in the valley like a person in distress and trouble, till she crossed the valley and
reached the Marwa mountain where she stood and started looking, expecting to see somebody, but she
could not see anybody. She repeated that (running between Safa and Marwa) seven times."
The Prophet (ﷺ) said, "This is the source of the tradition of the walking of people between them (i.e. Safa
and Marwa). When she reached the Marwa (for the last time) she heard a voice and she asked herself
to be quiet and listened attentively. She heard the voice again and said, 'O, (whoever you may be)!
You have made me hear your voice; have you got something to help me?" And behold! She saw an
angel at the place of Zamzam, digging the earth with his heel (or his wing), till water flowed from that
place. She started to make something like a basin around it, using her hand in this way, and started
filling her water-skin with water with her hands, and the water was flowing out after she had scooped
some of it."
The Prophet (ﷺ) added, "May Allah bestow Mercy on Ishmael's mother! Had she let the Zamzam (flow
without trying to control it) (or had she not scooped from that water) (to fill her water-skin), Zamzam
would have been a stream flowing on the surface of the earth." The Prophet (ﷺ) further added, "Then she
drank (water) and suckled her child. The angel said to her, 'Don't be afraid of being neglected, for this
is the House of Allah which will be built by this boy and his father, and Allah never neglects His
people.' The House (i.e. Ka`ba) at that time was on a high place resembling a hillock, and when
torrents came, they flowed to its right and left. She lived in that way till some people from the tribe of
Jurhum or a family from Jurhum passed by her and her child, as they (i.e. the Jurhum people) were
coming through the way of Kada'. They landed in the lower part of Mecca where they saw a bird that
had the habit of flying around water and not leaving it. They said, 'This bird must be flying around
water, though we know that there is no water in this valley.' They sent one or two messengers who
discovered the source of water, and returned to inform them of the water. So, they all came (towards
the water)." The Prophet (ﷺ) added, "Ishmael's mother was sitting near the water. They asked her, 'Do you
allow us to stay with you?" She replied, 'Yes, but you will have no right to possess the water.' They
agreed to that." The Prophet (ﷺ) further said, "Ishmael's mother was pleased with the whole situation as
she used to love to enjoy the company of the people. So, they settled there, and later on they sent for
their families who came and settled with them so that some families became permanent residents
there. The child (i.e. Ishmael) grew up and learnt Arabic from them and (his virtues) caused them to
love and admire him as he grew up, and when he reached the age of puberty they made him marry a
woman from amongst them.
After Ishmael's mother had died, Abraham came after Ishmael's marriage in order to see his family
that he had left before, but he did not find Ishmael there. When he asked Ishmael's wife about him, she
replied, 'He has gone in search of our livelihood.' Then he asked her about their way of living and their
condition, and she replied, 'We are living in misery; we are living in hardship and destitution,'
complaining to him. He said, 'When your husband returns, convey my salutation to him and tell him to
change the threshold of the gate (of his house).' When Ishmael came, he seemed to have felt
something unusual, so he asked his wife, 'Has anyone visited you?' She replied, 'Yes, an old man of
so-and-so description came and asked me about you and I informed him, and he asked about our state
of living, and I told him that we were living in a hardship and poverty.' On that Ishmael said, 'Did he
advise you anything?' She replied, 'Yes, he told me to convey his salutation to you and to tell you to
change the threshold of your gate.' Ishmael said, 'It was my father, and he has ordered me to divorce
you. Go back to your family.' So, Ishmael divorced her and married another woman from amongst
them (i.e. Jurhum).
Then Abraham stayed away from them for a period as long as Allah wished and called on them again
but did not find Ishmael. So he came to Ishmael's wife and asked her about Ishmael. She said, 'He has
gone in search of our livelihood.' Abraham asked her, 'How are you getting on?' asking her about their
sustenance and living. She replied, 'We are prosperous and well-off (i.e. we have everything in
abundance).' Then she thanked Allah' Abraham said, 'What kind of food do you eat?' She said. 'Meat.'
He said, 'What do you drink?' She said, 'Water." He said, "O Allah! Bless their meat and water." The
Prophet added, "At that time they did not have grain, and if they had grain, he would have also
invoked Allah to bless it." The Prophet (ﷺ) added, "If somebody has only these two things as his
sustenance, his health and disposition will be badly affected, unless he lives in Mecca." The Prophet (ﷺ)
added," Then Abraham said Ishmael's wife, "When your husband comes, give my regards to him and
tell him that he should keep firm the threshold of his gate.' When Ishmael came back, he asked his
wife, 'Did anyone call on you?' She replied, 'Yes, a good-looking old man came to me,' so she praised
him and added. 'He asked about you, and I informed him, and he asked about our livelihood and I told
him that we were in a good condition.' Ishmael asked her, 'Did he give you any piece of advice?' She
said, 'Yes, he told me to give his regards to you and ordered that you should keep firm the threshold of
your gate.' On that Ishmael said, 'It was my father, and you are the threshold (of the gate). He has
ordered me to keep you with me.'
Then Abraham stayed away from them for a period as long as Allah wished, and called on them
afterwards. He saw Ishmael under a tree near Zamzam, sharpening his arrows. When he saw
Abraham, he rose up to welcome him (and they greeted each other as a father does with his son or a
son does with his father). Abraham said, 'O Ishmael! Allah has given me an order.' Ishmael said, 'Do
what your Lord has ordered you to do.' Abraham asked, 'Will you help me?' Ishmael said, 'I will help
you.' Abraham said, Allah has ordered me to build a house here,' pointing to a hillock higher than the
land surrounding it." The Prophet (ﷺ) added, "Then they raised the foundations of the House (i.e. the
Ka`ba). Ishmael brought the stones and Abraham was building, and when the walls became high,
Ishmael brought this stone and put it for Abraham who stood over it and carried on building, while
Ishmael was handing him the stones, and both of them were saying, 'O our Lord! Accept (this service)
from us, Verily, You are the All-Hearing, the All-Knowing.' The Prophet (ﷺ) added, "Then both of them
went on building and going round the Ka`ba saying: O our Lord ! Accept (this service) from us,
Verily, You are the All-Hearing, the All-Knowing." (2.127)
Sahih al-Bukhari Book 60, Hadith 38
We went out with the Messenger of Allah (ﷺ) accompanying the bier of a man of the Ansar. When we reached his grave, it was not yet dug. So the Messenger of Allah (ﷺ) sat down and we also sat down around him as if birds were over our heads. He had in his hand a stick with which he was scratching the ground.
He then raised his head and said: Seek refuge with Allah from the punishment in the grave. He said it twice or thrice.
The version of Jabir adds here: He hears the beat of their sandals when they go back, and at that moment he is asked: O so and so! Who is your Lord, what is your religion, and who is your Prophet?
Hannad's version says: Two angels will come to him, make him sit up and ask him: Who is your Lord?
He will reply: My Lord is Allah. They will ask him: What is your religion? He will reply: My religion is Islam. They will ask him: What is your opinion about the man who was sent on a mission among you? He will reply: He is the Messenger of Allah (ﷺ). They will ask: Who made you aware of this? He will reply: I read Allah's Book, believed in it, and considered it true; which is verified by Allah's words: "Allah's Book, believed in it, and considered it true, which is verified by Allah's words: "Allah establishes those who believe with the word that stands firm in this world and the next."
The agreed version reads: Then a crier will call from Heaven: My servant has spoken the truth, so spread a bed for him from Paradise, clothe him from Paradise, and open a door for him into Paradise. So some of its air and perfume will come to him, and a space will be made for him as far as the eye can see.
He also mentioned the death of the infidel, saying: His spirit will be restored to his body, two angels will come to him, make him sit up and ask him: Who is your Lord?
He will reply: Alas, alas! I do not know. They will ask him: What is your religion? He will reply: Alas, alas! I do not know. They will ask: Who was the man who was sent on a mission among you? He will reply: Alas, alas! I do not know. Then a crier will call from Heaven: He has lied, so spread a bed for him from Hell, clothe him from Hell, and open for him a door into Hell. Then some of its heat and pestilential wind will come to him, and his grave will be compressed, so that his ribs will be crushed together.
Jabir's version adds: One who is blind and dumb will then be placed in charge of him, having a sledge-hammer such that if a mountain were struck with it, it would become dust. He will give him a blow with it which will be heard by everything between the east and the west except by men and jinn, and he will become dust. Then his spirit will be restored to him.
Sunan Abi Dawud Book 42, Hadith 158
Yahya related to me from Malik from Nafic from Abdullah ibn Umar
that a man cursed his wife in the time of the Messenger of Allah, may
Allah bless him and grant him peace, and disowned her child. The
Messenger of Allah, may Allah bless him and grant him peace, separated
them and gave the child to the woman.
Malik said, "Allah the
Blessed, the Exalted, said, 'The testimony of men who accuse their
wives but do not have any witnesses except themselves is to testify by
Allah four times that he is being truthful, and a fifth time, that the
curse of Allah will be upon him, if he should be a liar. She will
avoid punishment if she testifies by Allah four times that he is a
liar, and a fifth time, that the wrath of Allah shall be upon her, if
he should be telling the truth. ' "(Sura 24 ayat 6).
Malik
said, "The sunna with us is that those who curse each other are never
to be remarried. If the man calls himself a liar, (i.e. takes back his
accusation), he is flogged with the hadd-punishment, and the child is
given to him, and his wife can never return to him. There is no doubt
or dispute about this sunna among us. "
Malik said, "If a man
separates from his wife by an irrevocable divorce by which he cannot
return to her, and then he denies the paternity of the child she is
carrying, whilst she claims that he is the father, and it is possible
by the timing, that he be so, he must curse her, and the child is not
recognised as his."
Malik said, "That is what is done among
us, and it is what I have heard from the people of knowledge."
Malik said that a man who accused his wife after he had divorced
her trebly while she was pregnant, and he had at first accepted being
the father but then claimed that he had seen her committing adultery
before he separated from her, was flogged with the hadd-punishment,
and did not curse her.
If he denied the paternity of her
child after he had divorced her trebly, and he had not previously
accepted it, then he cursed her.
Malik said, "This is what I
have heard."
Malik said, "The slave is in the same position
as the free man as regards making accusations and invoking mutual
curses (lian). He acts in the lian as the free man acts although there
is no hadd applied for slandering a female-slave."
Malik
said, "The muslim slave-girl and the christian and jewish free woman
also do lian when a free muslim marries one of them and has
intercourse with her. That is because Allah - may He be blessed and
Exalted, said in His Book, 'As for those who accuse their wives,' and
they are their wives. This is what is done among us.
Malik
said that a man who did the lian with his wife, and then stopped and
called himself a liar after one or two oaths and he had not cursed
himself in the fifth one, had to be flogged with the hadd-punishment,
but they did not have to be separated.
Malik said that if a
man divorced his wife and then after three months the woman said, "I
am pregnant," and he denied paternity, then he had to do lian.
Malik said that the husband of a female slave who pronounced the
lian on her and then bought her, was not to have intercourse with her,
even if he owned her. The sunna which had been handed down about a
couple who mutually cursed each other in the lian was that they were
never to return to each other.
Malik said that when a man
pronounced the lian against his wife before he had consummated the
marriage, she only had half of the bride price.
Muwatta Malik Book 29, Hadith 39
"A woman borrowed some jewelry, saying that other people whose names were known but hers was not then she sold it and kept the money. She was brought to the Messenger of Allah, and her people went to Usamah bin Zaid, who spoke to the Messenger of Allah concerning her. The face of ht Messenger of Allah changed color while he was speaking to him. Then the Messenger of Allah said to him: 'Are you interceding with me concerning one of ht Hadd punishments decreed by Allah?' Usamah said: 'Pray for forgiveness for me, O Messenger of Allah! Then the Messenger of Allah stood up that evening, he praised and glorified Allah, the mighty and sublime, as he deserves, then he said: 'The people who came before you were destroyed because, whenever a noble person among them stole, they let him go. But if a low-class person stole, they would carry out the punishment on him. By the One in whose hand is the soul of Muhammad, if Fatimah bint Muhammad were to steal, I would cut off her hand.' Then he cut off that woman."
Sunan an-Nasa'i Book 46, Hadith 29
